Thomas J. Linnihan

Thomas J. Linnihan is a partner and attorney in the firm of Brownson & Ballou, PLLP. After spending several years in a general litigation defense practice, Mr. Linnihan has specialized in Workers' Compensation where he has concentrated his practice for twenty years. During that period, Mr. Linnihan's practice has been almost exclusively devoted to the defense of workers' compensation claims in Minnesota.

With the extreme complexity of the ever-changing Workers' Compensation law in this state, limiting his practice to this field of law has allowed Mr. Linnihan to provide the best available legal services to the firm's clients. Mr. Linnihan has been appointed as an Equitable Apportionment Arbitrator under the Minnesota Workers' Compensation Act.

In addition to defending numerous insurance companies, Mr. Linnihan has defended major self-insured employers in Workers' Compensation matters. These have included advising, directing strategy, and defending an employer against several hundred occupational disease claims over a period of several years.

Mr. Linnihan has been retained as Portfolio Network Counsel by a major property and casualty insurer to handle all asbestos-related workers’ compensation cases in Minnesota.

This Workers’ Compensation defense practice, also involves complex questions of liability allocation, trial and settlement strategy, trial hearings and appellate practice at the Workers’ Compensation Court of Appeals, and the Minnesota Supreme Court,, excess insurance coverage, reimbursement, subrogation, indemnity, and the interplay relationship with related civil litigation involving employer liability, contribution, and exclusive remedy provisions of the Minnesota Workers’ Compensation Act.

Mr. Linnihan is also admitted to practice law in the State of Wisconsin, where he has developed a civil litigation and Workers' Compensation practice.

Mr. Linnihan has testified as an expert witness with respect to Workers’ Compensation matters.

Mr. Linnihan is AV rated by the Martindale-Hubbell Law Directory.
